Petition seeking bail in respect of Crime No.485 of 2024 registered for the offences punishable under Section 77 of BNS r/w Section 67 of Information Technology Act, is on board for consideration. 1/4

2. The incarceration of the petitioner being from 29.11.2024 pleading innocence on the part of the petitioner and false implication in the case, learned counsel for the petitioner seeks indulgence of this Court. He also submits that the petitioner, who is a Doctor by profession, is in no way connected with the alleged offence and he is ready to abide by any stringent condition that may be imposed by this Court

3. The case of the prosecution as putforth by the learned Government Advocate (Criminal Side) appearing for the respondent police, opposing for grant of bail, is that the petitioner/accused is facing allegations of fixing pen camera in the ladies rest room. He further submits that the case was registered based on the complaint given by the Superintendent, District Head Quarters, Government Hospital, Pollachi and the petitioner, who is a practicing Doctor, caught during the verification of CCTV footage. He also submits that the investigation in this case is at preliminary stage and the petitioner was also arrested very recently on 29.11.2024, therefore, if the petitioner is released on bail, there is every possibility of him absconding and not available for further investigation.

4. Having heard the learned counsel for the petitioner and the learned 2/4

Government Advocate (Criminal Side) for the respondent Police and perused the materials available on record and considering the fact the petitioner was arrested very recently and the investigation is also at nascent stage, this court is not inclined to grant bail to the petitioner.
