O R D E R

The petitioner, who was arrested and remanded to judicial custody on 26.08.2025, for the offences punishable under Sections 75, 79, 351(3) of BNS Act, 2023 r/w 4 of TNPWH Act and 66D and 67A of I.T Act in Crime No. 153 of 2025, on the file of the respondent police, seeks bail. 1/6

2. The allegation against the petitioner is that the petitioner was a friend of the victim girl, aged about 21 years. It is alleged that he moved closely with her, started to share photographs and also compelled her to have physical relationship with him which was refused by the victim girl. However, the petitioner persisted and continued his contact which resulted in lodging of complaint by the defacto complainant, who is the father of the victim girl. The respondent police have also conducted enquiry and advised the petitioner to desist from such acts. Even thereafter, the petitioner is said to have harassed the victim girl. Further, the petitioner created a fake ID in the name of victim girl and uploaded morphed photographs of the victim girl with obscene messages in the ID of the victim girl which forced the victim girl to commit suicide. Further, the petitioner called the defacto complainant and abused him in a filthy language which resulted in registration of FIR.

3. Learned counsel appearing for the petitioner submitted that the petitioner and the victim girl were students studying together and they were also known to each other. He submits that due to their age, they became close but later, difference of opinion arose between them which resulted in lodging of complaint against this petitioner. Hence, he prayed for grant of bail to the petitioner.

The learned Government Advocate (Crl. Side) appearing for the respondent, while opposing for grant of bail to the petitioner, reiterated the prosecution case and submitted that during the enquiry at the CSR stage itself, the petitioner had tendered his apology and also given an undertaking that he will not engage in similar activities. Despite this, the petitioner had created a fake ID in the name of the victim girl and uploaded various morphed and obscene photographs with abusive messages caused severe mental agony to the victim girl which lead to an attempt to commit suicide. 5.

Considering the facts and circumstances of the case, allegation against the petitioner, submissions made by the learned counsels on either side, considering the gravity of the offence committed by the petitioner, this Court is not inclined to grant bail to the petitioner.
