O R D E R

The petitioner, who was arrested and remanded to judicial custody on 13.08.2025, for the offences punishable under Sections 8(c), 20(b)(ii)(B) and 29(1) of Narcotic Drugs and Psychotropic Substances Act, 1985 in Crime No. 428 of 2025, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the accused persons, who were 1/4

arrayed as A1 to A3 were arrested and 1.150 Kilograms of ganja were seized. During investigation, it is revealed that this petitioner used to supply the same and the respondent police seized the contraband supplied by the petitioner herein.

3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He also submits that co-accused in this case were enlarged on bail. Hence, he prayed for grant of bail to the petitioner. 4.

The learned Government Advocate (Crl. Side) appearing for the respondent, while opposing for grant of bail to the petitioner, reiterated the prosecution case and submitted that totally there are 7 accused in this case and this petitioner was arrayed as A6. He also submits that petitioner along with others were found in illegal possession of 1.150 Kilograms of ganja. He also submits that there are 11 previous cases pending against this petitioner out of which two were similar in nature. He also submits that petitioner is the supplier of the contraband. Hence, he opposed to grant bail. 2/4

Considering the facts and circumstances of the case, the allegation against the petitioner, submissions made by the learned counsels on either side, taking into account the fact that the contraband was supplied by the petitioner and that he has bad antecedent, also the fact that investigation in this case is not yet concluded, this Court is not inclined to grant bail to the petitioner.
