a Writ of Mandamus, directing the Respondents 2 and 3 to consider the complaints of the petitioner dated 18.08.2023, 06.06.2024 and 06.02.2025 addressed to the Superintendent of Police, Salem, and to take action against the respondents 6 to 8 for having conspired and impersonated in creating a forged rental agreement in respect of Door No. 365 dated 25.08.2001, and for executing a fraudulent sale deed in respect of Document No. 3747/2009 dated 09.04.2009 registered in the office of the Sub-Registrar, by impersonation, forgery, cheating and fraudulent registration and to conduct an inquiry and investigation against respondents 6 to 8 for the aforesaid offences, within a time frame to be fixed by this Honble Court, as the acts complained are offences against the State.

ORDER

This Writ Petition has been filed seeking to issue a Writ of Mandamus, directing the Respondents 2 and 3 to consider the complaints of the petitioner dated 18.08.2023, 06.06.2024 and 06.02.2025 addressed to the Superintendent of Police, Salem, and to take action against the respondents 6 to 8 for having conspired and impersonated in creating a forged rental agreement in respect of a property viz., Door No. 365 dated 25.08.2001, and for executing a fraudulent sale deed in respect of Document No. 3747/2009 dated 09.04.2009 registered in the office of the Sub-Registrar, by impersonation, forgery, cheating and fraudulent registration and to conduct an inquiry and investigation against 2/5

respondents 6 to 8 for the aforesaid offences, within a time frame.

2. Heard the learned counsel for the petitioner, learned counsel for the private respondents and the learned Government Advocate (Crl.Side) appearing for the official respondents.

3. In respect of the same complaint dated 18.09.2023, the petitioner had already filed a petition in Crl.O.P.No.20161 of 2023 seeking police protection to the petitioner and this court had already disposed of the said petition directing the petitioner to work out his remedy before the competent civil Court.. Further, the petitioner filed a W.P.No.36578 of 2024 seeking police protection to the petitioner to secure his property. Considering that the dispute is civil in nature, the same has also been dismissed.

4. Now this is the third round of litigation. Suppressing the earlier orders, the present writ petition has been filed. According to the petitioner, one of his tenants has executed tenancy agreement in favour of another person. Therefore, those documents according to the petitioner are forgery. If the petitioner was allotted that property, it is for the petitioner to establish his right before the competent civil Court in a civil suit and not by way of this writ petition.

5. In view of the above, this Writ Petition is dismissed. 16-10-2025 mfa 3/5
