O R D E R

The Criminal Original Petition has been filed seeking a direction to the respondent Police not to harass the petitioner under the guise of investigation or enquiry.

The case of the petitioner is that the petitioner Company is the owner of a commercial property known as "Cheran Towers", Coimbatore and the second respondent is running a showroom in the name of "Nexa EV Tech" in one of the portions of the said Cheran Towers. There arose a dispute between the petitioner and the second respondent with regard to non-payment of rent and consequently, arbitration proceedings are also pending between them. However, the second respondent has lodged a complaint against the petitioner, pursuant to which, the respondent Police are allegedly harassing the petitioner under the pretext of enquiry. The petitioner has already produced all the documents sought for by the respondent. Despite the same, repeated summons have been issued, causing unnecessary harassment to the petitioner.

In view of the above, since the dispute between the parties is purely a civil dispute, the respondent Police are directed not to interfere in the civil dispute between the petitioner and the second respondent, except in the event of any law and order issue arising therefrom, which may warrant initiation of criminal proceedings. The respondent Police, on perusal of the documents already produced by the petitioner, shall relegate the parties to work out their remedies before the appropriate forum and shall refrain from summoning the petitioner for enquiry unnecessarily.

4. Accordingly, this Criminal Original Petition stands disposed of with the above directions.
