ORDER
This writ petition has been filed seeking to direct the respondents to consider the petitioner's representation dated 12.03.2025 and for a consequential direction to the 4th respondent to deposit the arrears of family pension in favour of the petitioner.
2. Mr.Azizulla Khan, learned Government Advocate takes notice on behalf of the respondents. In view of the consent expressed by the learned counsel on either side, this writ petition is taken up for final disposal at the admission stage itself.
3. The case of the petitioner is that, his father late G.Nambirajan was a District and Sessions Judge at Pudukottai and he passed away in the year 1975, while he was in Judicial Service. Thereafter, the petitioner's mother late N.Muthulakshmi was granted family pension till her expiry i.e. 2/6
22.12.2022, vide in PPO No.FA 51142. Pursuant to the implementation of the Second National Judicial Pay Commission (in short 'SNJPC') recommendations, which were approved by the Hon'ble Supreme Court of India vide in W.P.(C)No.643 of 2015 in the case of All India Judges Association & Others vs. Union of India & Others, and further implemented by the Government of Tamil Nadu through G.O.(Ms).Nos.384 and 385, Home (Courts-1) Department, dated 26.07.2023, the same was further notified through G.O.(Ms).No.473, Home (Courts-1) Department, dated 14.08.2024. As per the said G.Os., the petitioner's mother was eligible for revision with retrospective effect from 01.01.2016. The arrears of family pension due for the month of December, 2022 in the old scales of pay, was fully paid in favour of the petitioner.
For non-payment of arrears of family pension due as per the revised scales, the petitioner made a representation before the 4th respondent on 12.03.2025, seeking payment of arrears of family pension from 01.01.2016 to 22.12.2022, as per the revised scales of pay. However, as the same evoked no response, the petitioner has come up with this writ petition.
4. Learned counsel for the petitioner submitted that, it would suffice, 3/6
if this Court issues a direction to the 4th respondent to consider the petitioner's representation dated 12.03.2025 and to consequently pay the arrears of family pension in favour of the petitioner, as expeditiously as possible.

Learned Government Advocate appearing for the respondents submitted that, the competent authority to consider the claim of the petitioner is the 3rd respondent and if any representation is made before the 3rd respondent, the same will considered and appropriate orders will be passed within the time stipulated by this Court.

In view of the above, this Court, without going into the merits of the case, directs the petitioner to send a copy of the representation dated 12.03.2025 to the 3rd respondent within a period of two (2) weeks from the date of receipt of a copy of this order and upon receipt of the said representation, the 3rd respondent shall consider the same and pass appropriate orders on merits and in accordance with law, within a period of twelve (12) weeks thereafter, after affording an opportunity of hearing to the 4/6
petitioner.
7. With the above directions, this writ petition stands disposed of. No costs.
