ORDER

The learned counsel appearing for the petitioner would submit that the impugned order was passed under Order XXXIX Rule 1 and 2 and Sections 94 and 151 of the CPC, which is an appealable order. Hence, he seeks 2/4

permission of this Court to withdraw the Civil Revision Petition with liberty to file an appeal. He has also made an endorsement to that effect in the case bundle.

2. In view of the submission and the endorsement so made by the learned counsel for the revision petitioner, liberty is granted to the revision petitioner to file an appropriate appeal in the manner known to law. Accordingly, this Civil Revision Petition is dismissed as withdrawn. Considering the facts there shall be no orders as to costs. Consequently, connected Civil Miscellaneous Petition is closed.

3. The Registry is directed to return the original affidavit and petition in I.A.No.125 of 2025 in O.S.No.30 of 2022, filed along with the civil revision petition, forthwith.
