ORDER

This Criminal Original Petition has been filed to issue directions to the respondents not to harass the petitioners under the guise of enquiry.

2. The case of the petitioners is that after termination of partnership with one Rasool, the said Rasool colluded with one Sathya and lodged a false complaint alleging that the petitioners had borrowed a sum of Rs.50,00,000/- on 2/6

account of which, the petitioners had received calls from the police officials and directed to appear for enquiry. Further, the petitioners came to know that the said Rasool had misused the signed cheques, which had been kept at regular business transactions. The petitioners were also warned that their lives would be in danger, these repeated threats, harassments over phone and continuous intimidation have caused severe mental agony. Hence, this petition.

3. The learned Additional Public Prosecutor appearing for the respondents, on instructions submitted that current paper enquiry is pending against the petitioners and the petitioners were called for enquiry and the respondents have not harassed the petitioners.

4. In such view of the matter, it is for the investigating agency to issue appropriate notice to the petitioners under Section 35(3) of BNSS for enquiry and on such notice, the petitioners shall appear for enquiry and co-operate with the investigation. If any cognizable offence is made out, the respondents shall register the First Information Report and proceed as per law. 3/6

5. With the above direction, this Criminal Original Petition is disposed of.
