Respondent PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a writ of Certiorarified Mandamus, calling for the records relating to the online rejection order in Application Number in TN5202410292002 (Raghu) dated NIL quash the same and direct the respondent to issue community certificate to the petitioner and his children namely R.Bhagyalakshmi and R.Manjunath that they belong to Kurichchan (ST) Community based upon the community certificate already issued to the petitioner in C.D.No. 484/82 dated 12.07.1982 (PRAYER AMENDED AS PER ORDER DATED 21.01.2025 IN WMP.503/2025 IN WP.39403/2024 BY RSMJ AND CKJ).

ORDER

[Order of the Court was made by R.SUBRAMANIAN, J] The challenge is to the online rejection of the request of the petitioner for issuance of online community certificate for himself and his children dated 29.10.2024. The petitioner has already been favoured with the certificate to the effect that he belongs to the Scheduled Tribe community "Kurchchan" by the Tahsildar, Denkanikottai on 12.07.1982. The certificate is said to be in force even today. As it appears from the online order is that the petitioner has not submitted the State Level Scrutiny Committee order. Scrutiny is undertaken by the State Level Committee only, in case a doubt is raised. The certificate issued to the petitioner is dated 12.07.1982. Admittedly, there has been no attempt to verify the same till date. Therefore, it remains valid as of today.

2. Mr.Vadivel Deenadayalan, learned Additional Government Pleader appearing for the respondent would submit that this certificate dated 2/4

12.07.1982 was not uploaded and if the petitioner applies again uploading the certificate, the application for grant of community certificate will be considered by the respondent.

3. This writ petition is disposed of with a liberty to the petitioner to apply afresh uploading the certificate dated 12.07.1982. On such application, the respondent shall pass necessary orders within a period of six(6) weeks from the date of filing of the online application. It is pertinent to point out that G.O.Ms.No.104 dated 21.08.2023 makes it clear that if the parents are favoured with certificate, the children would also be entitled to the certificate. No costs.
