ORDER

The petitioner, who was arrested and remanded to judicial custody on 04.08.2025 for the offences punishable under Section 103(1) of BNS (Under Section 302 of IPC) in Crime No.522 of 2025, registered on the file of the respondent police, seeks bail.

The case of the prosecution is that on 01.08.2025, the accused followed the defacto complainant's husband, attacked and assaulted him with knife; that thereafter the defacto complainant's husband was taken to hospital, where he was declared dead; that upon investigation, it is revealed that the petitioner was also involved in the offence. Hence, this case 3.

The learned counsel for the petitioner submitted that the petitioner has been falsely implicated in this case, since the petitioner is the friend of A1 and he is in judicial custody since 04.08.2025. He further submitted that the petitioner is ready to abide by any condition that may be imposed by this Court and sought for bail to the petitioner. 4.

The learned Government Advocate (Crl. Side) appearing for the respondent while opposing the bail to the petitioner reiterated the 2/4

prosecution case and submitted that there are totally four accused in this case and the petitioner is arrayed as A3, who had conspired with other accused/ A1 and A2 and committed murder of the deceased. He also submitted that during further course of investigation, it is revealed that the wife of the deceased is also involved in the offence and she has been arrayed as A4 in this case and that the investigation is pending. 5.

Considering the facts and circumstances of the case, grave nature of offence and taking note of the fact that the investigation of this case is pending, this Court is not inclined to grant bail to the petitioner. 6.

Accordingly, this criminal original petition stands dismissed. 08.10.2025 stn K. RAJASEKAR, J.
