Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of Mandamus, directing the respondent to consider the representation of the petitioner, dated 31.07.2025 to survey and measure the petition property, being a southern side portion of a vacant site, measuring to an extent of 0.15 cents (or) 6545 sq.feet. out of extent of 0.30 cents, comprised in Old Survey No.381(part), 381/21/3 and as per Town survey Land Register, present survey No.23/1, Block -3, ward -D, Mookambigai Nagar extension, Tambaram Village and Taluk, Chengalput District and to issue patta in the name of petitioner. This Writ Petition has been filed for a direction directing the respondent to consider the representation of the petitioner dated 31.07.2025 to survey and measure the petition property, being a southern side portion of a vacant site, measuring to an extent of 0.15 cents (or ) 6545 sq.feet out of extent of 0.30 cents, comprised in Old Survey No.381(part), 381/21/3 and as per Town Survey Land Register, present survey No.23/1, Block-3, ward-D, Mookambigai Nagar extension, Tambaram Village and Taluk, Chengalput District and to issue patta in the name of petitioner.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

The case of the petitioner is that he is the owner of the land comprised in Old Survey No.381(part), 381/21/3 and as per Town Survey Land Register, present survey No.23/1, Block-3, ward-D, Mookambigai Nagar extension, Tambaram Village and Taluk, Chengalput District. In order to survey the said land, he submitted a representation before the respondent. However, the respondent did not take any steps to survey the aforesaid lands so far.

4. In view of the above, the respondent is directed to survey the 2/5

petitioner's aforesaid land based on the title deed produced by the petitioner, after issuance of notice to the adjacent land owners and counter parties, if any, and to serve the survey report to the petitioner within a period of six weeks from the date of receipt of a copy of this order. It is made clear that, if the surveyor concerned is obstructed by third parties while surveying the subject land, the said surveyor can approach the jurisdictional police seeking police aid and on such request, the jurisdictional police shall provide adequate police protection to the surveyor.

5. With the above directions, this writ petition is disposed of. There shall be no order as to costs.
