ORDER

This second appeal has been filed praying to allow the above Second Appeal by setting the Judgment and Decree in AS No. 6/2022 on the file of the Learned Subordinate Judge, Mettur dated 24.06.2025, confirmed, the first appellate court confirmed the Judgment and Decree passed in OS No. 2/2017 on the file of the Learned District Munsif, Mettur dated 23.10.2021.

2. Both parties along with their respective counsels appeared before this Court. The appellant is agreed to receive a sum of Rs.8,50,000/- as full and final settlement. To that effect a joint compromise memo is filed.

3. As per the terms of the joint compromise memo, the appellant is entitled to receive a sum of Rs.8,50,000/- from the pension arrears of deceased Arthanari from ATO, Mettur and the respondents 1 & 2 are entitled to receive remaining pension arrears, if any, and also they are entitled to receive the future monthly family pension. Further as per the terms of the compromise, the respondents 1 and 2 are declared as legal heir of the deceased Arthanari and the appellant has given up all her right, interest whatsoever in respect of deceased Arthanari, in future. The terms of joint compromise memo dated 06.02.2026

shall form part of this judgment. Accordingly, in view of the above terms, this Second Appeal is disposed of and suit is dismissed. No Costs. Further, if the appellant files any application to withdraw arrears of pension, Assistant Treasury officer, Mettur, is directed to disburse the same within a period of two weeks from the date of the application without unnecessary delay since the appellant is aged about 72 years.
