The Criminal Original Petition has been filed seeking to quash the First Information Report in Crime No.24 of 2023, pending on the file of the first respondent.

Heard the learned counsel appearing for the petitioners, the learned Government Advocate (Criminal Side) appearing for the first respondent and perused the materials available on record. 3.

Based on the complaint given by the de facto complainant/R2, a case in Crime No.24 of 2023 was registered against the accused for the offences under Sections 419, 420, 465, 468, 471 and 120B of IPC. The petitioner herein has been arrayed as A5.

It is the contention of the learned counsel appearing for the petitioner that the petitioner is an Advocate by profession and also engaged in documentation. In the present case, except for the preparation of the document, the petitioner has nothing to do with the alleged offence. The main allegation is attributed only against accused 1 to 4, who are alleged to have impersonated and fabricated the documents with the intention to grab 2/5

the property of the de facto complainant. Based on the documents provided by the other accused, the petitioner had drafted the sale deed. Hence, he prayed that the proceedings pending against the petitioner may be quashed. 5.

The de-facto complainant/R2 appeared before this Court and was identified by Mr.V.Balamurugan, Sub-Inspector of Police, DCB, 6.

On being enquired by this Court, the de facto complainant submitted that the present petitioner, who has been arrayed as A5, is in no way connected with the offence and that he has no objection to quash the proceedings as against the petitioner alone. He has also filed an Affidavit to that effect.

In view of the above, the Affidavit filed by the de facto complainant/second respondent is taken on record. The first respondent Police is directed to take note of the same and delete the name of the petitioner while filing the final report. The petitioner may, if necessary, be cited as a witness in this case.
