PRAYER Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a Writ of Mandamus directing the second respondent to dispose the Revision Petition dated 25.02.2025 in the subject matter of the property bearing Plot No.6 to an extent of 166 sq. mtrs. in Survey No.425, T.S.No.77, Ward-H, Block 76, Mogappair Village, Ambattur Taluk, Chennai District.

ORDER

This writ petition has been filed seeking issuance of a writ of mandamus directing the second respondent to dispose of the revision petition filed by the petitioner on 25.02.2025 within the time frame fixed by this Court.

2. Heard Ms.V.Ananthi, learned counsel for petitioner and Mr.D.Ravichander, learned Special Government Pleader appearing for respondents 1 to 4.

The case of the petitioner is that he is the owner of the subject property and he had settled the property in favour of his wife by settlement deed dated 12.09.2016 and thereafter, the petitioner was forced to cancel this document. The specific case of the petitioner is that the assignment patta was issued in his favour as early as in the year 1989 and in spite of the same, patta was issued in favour of the private party.

4. The petitioner, aggrieved by the proceedings of the third respondent dated 27.01.2025, has filed the revision before the second respondent on 25.02.2025. Since there was no progress, the present writ petition has been filed.

5. Taking into consideration the facts and circumstances of the case and without going into the merits of the case, there shall be a direction to the second respondent to deal with the revision filed by the petitioner on 25.02.2025 on its own merits and in accordance with law after affording opportunity to all interested parties and final orders shall be passed within a period of eight (8) weeks from the date of receipt of a copy of this order.
