PRAYER:-Writ Petition filed under Article 226 of the Constitution of India, praying for an issuance of Writ of Mandamus, directing the respondents to grant the petitioner a reasonable extension of six months from the date of the order of this Court to enable the petitioner to safely and properly remove the petitioner's movable assets demolish existing structures and vacant the property bearing Survey No.843/1F, Sriperumbudur Town and Taluk, Kanchipuram District considering her status as a senior citizen, her husbands critical health and the practical difficulties of relocation.

ORDER
This writ petition has been filed by the petitioner seeking to direct the respondents to grant the petitioner a reasonable extension of six months from the date of the order of this Court to enable the petitioner to safely and properly remove the petitioner's movable assets demolish existing structures and vacant the property bearing Survey No.843/1F, Sriperumbudur Town and Taluk Kanchipuram District considering her status as a senior citizen, her husbands critical health and the practical difficulties of relocation.
2.Mr.P.Sathish, learned Additional Government Pleader, takes notice on behalf of the respondent. By consent of the parties, the main writ petition is taken up for disposal at the admission stage itself. 3.Learned counsel for the petitioner would submit that the petitioner's land comprised in S.No.843/1F, admeasuring 10 Ares, situated in Sriperumbudur Village, Kancheepuram District was acquired by the Government for the Chennai Outer Ring Road Project and the compensation of Rs.1,81,21,767/- was paid to the petitioner on 29.07.2025. However, according to the petitioner, the said compensation was calculated wrongly and the interest for the delay period in depositing the award amount was not granted. Since the quantum of compensation is on the lower side, the petitioner made an application for re-determination of compensation. While so, the 1 st respondent is insisting the petitioner to vacate the premises and the petitioner seeks another six months time to vacate the subject property.
4.Learned Additional Government Pleader appearing for the respondents would submit that the petitioner being received the compensation of Rs.1,81,21,767/- on 29.09.2025 and now refusing to vacate the premises, which cause unneccesary delay in laying the road. Further, in case any application has been filed by the petitioner for enhancement of compensation, the same will be considered in accordance with law.
5.Heard the learned counsel for the petitioner as well as the learned Additional Government Pleader appearing for the respondents and perused the materials available on records.
6.Considering the submissions made by either parties, this Court finds force in the submissions made by the learned Additional Government Pleader appearing for the respondents that after receiving the original award amount of Rs.1,81,21,767/-, the petitioner is now seeking another six months time for vacating the premises. The request of the petitioner cannot be accepted since the delay will prevent the respondents from laying road which would incur
unnecessary costs in laying roads. Taking note of this aspect and the request of the petitioner, this Court inclined to grant another 30 days time for the petitioner to vacate the premises. Accordingly, this Court pass the following orders:- (i) The petitioner is directed to vacate the subject property on or before 17.11.2025. In the event of failure on the part of the petitioner in vacating the subject property, the respondents can take necessary steps to evict the petitioner from the subject property in accordance with law. (ii) Further, in case the representation of the petitioner for enhancement of compensation is not considered, it is open to the petitioner to approach the appropriate Court seeking for early disposal of the petitioner's representation. 7.With the above directions, this writ petition is disposed of.
