ORDER

The petitioner, who was arrested and remanded to judicial custody on 05.04.2025, for the offences punishable under Sections 8(c), 22(c), 29(1) of NDPS Act, 1985 in Crime No.77 of 2025, registered on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the petitioner along with other accused were found in illegal possession of 80 grams of Methamphetamine. Hence, this case.

3.The learned counsel appearing for the petitioner submitted that only based on the confession given by the co-accused the petitioner has been implicated in this case. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.

4.The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and states that the quantity involved in this case is commercial quantity. He also submitted that this is the third bail petition and the earlier bail petitions filed by the petitioner in Crl.O.P.No. 16588 of 2025 and Crl.O.P.No. 21949 of 2025 was dismissed by this Court on 23.06.2025 and 23.09.2025 respectively.

5.The specific case of the prosecution as stated is that the quantity involved in this case is commercial in nature. Therefore, the petitioner has to satisfy the stipulations laid down under Section 37 of NDPS Act and he failed to do so.

In view of the above facts and the earlier bail petitions filed by the petitioner in Crl.O.P.No. 16588 of 2025 and Crl.O.P.No. 21949 of 2025 was dismissed by this Court on 23.06.2025 and 23.09.2025 and there is no change in circumstances, this Court is not inclined to grant bail to the petitioner. This Criminal Original Petition stands dismissed . 12.01.2026 smn 3/4
