The petitioner, who was arrested and remanded to judicial custody on 04.09.2025, for the offence punishable under Section 123 of BNS and Section 77 of JJ Act, in Crime No.154 of 2025, registered on the file of the 1/4

respondent, seeks bail.

2. The case of the prosecution is that the petitioner was found in possession of Tapentadol Tablets 100 mg (Vtidol N 100), Sodium Chloride Injection IP 100 ml bottles, and GB MED Sterile Hypodermic Syringes. Upon enquiry, it was revealed that the petitioner had been administering the said drugs to workers from other States as well as to school and college students. Hence, the complaint.

3. Learned counsel appearing for the petitioner submitted that the petitioner is innocent and has been falsely implicated in this case. He further submitted that the petitioner has been in custody since 04.09.2025 and therefore prayed for grant of bail.

4. Learned Government Advocate (Criminal Side) appearing for the respondent police opposed the grant of bail, reiterating the prosecution case, and submitted that the petitioner has three previous criminal cases of a similar nature. He further submitted that the investigation is still pending.

5. Heard the learned counsels on either side and perused the materials available on record.

Considering the nature of the offence, the seriousness of the allegations involving administration of narcotic substances to students and others, the petitioner's previous criminal antecedents, and the fact that the investigation is still in progress, this Court is not inclined to grant bail to the petitioner.
