ORDER

By consent of both the parties, this writ petition is taken up for final disposal at the admission stage itself. Mr.R.U. Dinesh Rajkumar, learned Additional Government Pleader takes notice for the respondents 1 and 2 and Mr.Stalin Abimanyu, learned counsel takes notice for the 3rd respondent.

2. This writ petition has been filed for issuance of a Writ of Mandamus, seeking a direction to the 2nd respondent to consider the petitioner's representation dated 10.09.2025, within a time frame to be stipulated by this Court.

3. Short facts leading to the filing of this writ petition are as follows :- The petitioner, who is a sexagenarian, executed Settlement Deeds dated 28.12.2006 and 12.04.2007, in favour of her eldest son, the 4th respondent, on the assurance that he would maintain her and her husband during their lifetime. But, despite the said assurance given by the 4th respondent, he failed to provide even basic amenities to the petitioner. Consequently, she submitted a 2/5

representation before the 2nd respondent on 10.09.2025. It is the grievance of the petitioner, pending issue, the 4th respondent is attempting to alienate one of the properties in favour of his wife. Such being the position, based on an objection raised by the petitioner, the 3rd respondent refused registration, vide Refusal slip No.RFL/85/2025 dated 18.09.2025. Under such circumstances, the petitioner has rushed before this Court with the aforesaid prayer.

Learned Senior Counsel appearing for the petitioner would submit that, pending issue, the 4th respondent is attempting to alienate the properties, which were executed by the petitioner out of love and affection. In view of the above, the 2nd respondent may be directed to consider and dispose of the petitioner's representation dated 10.09.2025 seeking for the relief under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, within a time frame to be fixed by this Court.

Mr.R.U.Dinesh Rajkumar, learned Additional Government Pleader appearing for the respondents 1 and 2 would submit that the representation of the petitioner would be considered on merits and in accordance with law. Therefore, he has no objection for issuance of appropriate directions in this regard.

6. Considering the facts and circumstances of the case and having regard 3/5

to the submissions made by the learned counsel on either side, this Court without going into the merits of the case, directs the 2nd respondent to consider the petitioner's representation dated 10.09.2025 and pass appropriate orders on merits and in accordance with law, after affording an opportunity of personal hearing to the petitioner as well as the 4th respondent, within a period of eight weeks from the date of receipt of a copy of this order. Further, the 2nd respondent shall inform the 3rd respondent that till the disposal of the proceedings, the subject properties shall not be encumbered or alienated.
