ORDER
The petitioner has come forward with this Writ Petition seeking a direction upon the 2nd respondent to consider the petitioner's representation dated 08.09.2025 to permanently disconnect the illegal electricity service connection bearing Consumer No.090311451142, which has been unlawfully granted without online patta, revenue records or planning permission, in respect of the petitioner's land situated at Page No.2 of 6
Survey No.481/3C, Thirumullaivoyal Village, Avadi Taluk, Tiruvallur District.
2. Since no adverse order has been passed against the 7th respondent, notice to the 7th respondent is dispensed with.
3. Mr.L.Jai Venkatesh, learned Standing Counsel, accepts notice on behalf of the respondents 1 to 6. In view of the consent expressed by the learned counsel for the parties, this Writ petition is taken up for final disposal at the admission stage itself.
4. The petitioner is in lawful possession and enjoyment of the subject property by virture of a registered Power of Attorney dated 25.10.2021, however, in the petitioner's land, the 6th respondent has granted electricity service connection in favour of the 7th respondent. Therefore, the petitioner has lodged a complaint on 03.04.2025 to the Chief Minister's Special Cell and also made an online complaint before the law enforcing agency. Subsequently, the 6th respondent vide letter dated 19.04.2025, has categorically admitted that the service connection Page No.3 of 6
was provided without proper verification and that it was a mistake. Thereafter, the petitioner has made a representation dated 08.09.2025 before the respondents to disconnect the said electricity service connection which was illegally granted in favour of the 7th respondent. Since the same was not considered, the petitioner has filed this writ petition before this Court for appropriate orders.
5. The issue arises in this writ petition has to be decided only by a competent Civil Court. This Court cannot go into the merits or otherwise the claim made by the petitioner.
6. Therefore, this Writ Petition is dismissed giving liberty to the petitioner to raise all of his grievances as against the 7th respondent before the appropriate Civil Court.
