ORDER

Mr.Yogesh Kannadasan, learned Special Government Pleader takes notice for the 1st respondent. Since no adverse orders are being passed, notice to the 2nd to 4th respondents is dispensed with. With the consent of learned counsel for the petitioner and learned Special Government Pleader for the first respondent, this writ petition is taken up for final disposal at the admission stage itself.

2. This writ petition has been filed for issuance of a writ of mandamus, seeking a direction to the 1st respondent to consider the petitioner's representation dated 17.07.2025, within a time frame to be stipulated by this Court.

3. Short facts leading to the filing of this writ petition are as follows :- The petitioner, who is a septuagenarien, executed Release Deed bearing document No.2263 of 2022 dated 23.11.2022, in favour of her daughters, the 2nd to 4th respondents. Since there was a dispute among themselves with regard to payment of construction expenses, they often quarrel with each other and 2/5

never take care of the petitioner. It is the grievance of the petitioner that the third respondent also took away her gold ornaments and cash. Consequently, she submitted a representation before the 1st respondent on 17.07.2025 for cancellation of the above said release deed. Since there was no action taken on the said representation, the petitioner has approached this Court with the aforesaid prayer.

The learned counsel appearing for the petitioner would submit that the 1st respondent may be directed to consider and dispose of the petitioner's representation dated 17.07.2025 seeking relief under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, for cancellation of release deed document No.2263 of 2022 dated 23.11.2022 on the file of SRO, Periamet within a time frame to be fixed by this Court.

5. Mr.Yogesh Kannadasan, learned Special Government Pleader appearing for the 1st respondent would submit that the Revenue Divisional Officer concerned is the appropriate authority under the Act, whereas the petitioner has forwarded her representation to the 1st respondent. 3/5

Considering the facts and circumstances of the case and in view of the submission made by the learned Special Government Pleader appearing for the 1st respondent, this Court without going into the merits of the case, directs the 1st respondent to forward the representation of the petitioner dated 17.07.2025 to the jurisdictional Revenue Divisional Officer within a period of one week from the date of receipt of a copy of this order and thereafter, the Revenue Divisional Officer shall consider the petitioner's representation and pass appropriate orders on merits and in accordance with law, after affording an opportunity of personal hearing to the petitioner as well as to the respondents 2 to 4, within a period of eight weeks.

7. With the above directions, this Writ Petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed. 13.10.2025 Index:Yes/No Speaking/Non-speaking order dpq 4/5
