ORDER

I had disposed of W.P.No.38413 of 2025 by way of an order dated 13.10.2025 and posted the matter today for compliance.

2. When I took up the matter, Mr.Shahjahan, learned Special Government Pleader, produced instructions from the Tahsildar, Nallampalli 2/6

which states as follows:

"6. In compliance with the above directions, the Revenue Divisional Officer, along with the Deputy Superintendent of Police, Pennagaram, the Tahsildar, Nallampalli, and the Block Development Officer, Nallampalli, held discussions with the villagers and the family members of the deceased, providing them an opportunity to exhume the body themselves, On their request, two days' time was granted. However, as they failed to act, the Hon'ble High Court's order was implemented on 24.10.2025 at 2.00 P.M., under police protection, in the presence of the above officers. During the process, around 200 villagers gathered and attempted to obstruct the official proceedings, causing a law and order issue. With adequate police security, the body was exhumed and taken to the public burial ground at Dalavaihalli Villge, but due to continued objections from the public, the body was finally reinterred at the Dharmapuri Municipal Burial Ground in the presence of the deceased's sons and family members.

7. Further, regarding the petition for cancellation 3/6

of patta, notices were issued to both the pattadars and the petitioners to appear for final enquiry on 23.10.2025. The public petitioners failed to appear. The pattadars appeared through counsel and sought time to submit documents.

Accordingly, a fresh notice has been issued to both parties for further enquiry on 31.10.2025. After completion of the enquiry, appropriate orders will be passed in accordance with law.

8. Hence, the Hon'ble High Court's order dated 13.10.2025 in W.P.No.38413/2025 has been duly complied with."

As the order has been complied with, no further orders are necessary in this writ petition and accordingly, this writ petition is allowed. No costs.

3. The grievance expressed by Mr.Sivaraman that there is no separate burial ground accessible to the villagers cannot be considered in this writ petition. It is up to him to initiate separate proceedings for the said purpose. 25.10.2025 kal To 4/6
