ORDER

The revision challenges the condition imposed by the trial Court while ordering return of a sum of Rs.8,33,059.61/- said to be belonging to the petitioner which was seized by the respondent during the course of investigation in Cr.No.110/2024.

2. Ms.K.Suhasini, the learned counsel for the petitioner, would submit that admittedly the petitioner had established that he is a victim and he has been cheated to the tune of Rs.3,90,00,000/- and a sum of Rs.8,33,059.61/- has been recovered from 688 accounts; that he is entitled to the interim custody of the said amount and hence, the first condition, directing the petitioner to execute a bond for a sum of Rs.8,50,000/- with two sureties, is onerous.

3. Heard the learned Government Advocate (Crl.side) for the respondent.

4. Considering the averments made by the petitioner, this Court modifies the first condition imposed on the petitioner in the order of the learned Magistrate dated 09.06.2025 in Crl.M.P.No.1502/2025 as follows: " (i) The petitioner shall execute a bond for a sum of Rs.5,00,000/- (Rupees Eight Lakhs only) along with two sureties each for a like sum to the

satisfaction of the trial Court."

The other conditions imposed by the trial court remains unaltered.
