Respondents Prayer: Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus forbearing the respondents herein from constructing a working women hostel and a hostel for Girls for all educational institutions on the campus of the Ramanujan Institute for advance study in mathematics (RIASM), Chepauk, Chennai-600005 and consequently direct the respondents to protect and preserve the Ramanujan Institute for advance study in mathematics (RIASM), Chepauk, Chennai 600 005, without altering its academic nature.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) This petition is as frivolous as it could be. The construction of Hostel for Working Women and for Girls for providing residential facility to the students is taken a strong exception by the petitioner, who is a student, on his own figment of imagination, having no basis, that it will otherwise affect the advanced studies in Mathematics going on in the institution established in a huge campus running in 3.38 acres, out of which, a small portion is proposed to be used for construction of hostel

for working women/girls.

2. The Public Interest Litigation has been filed without any research and only to waste the time of the Court. We can only observe that the entire basis of the petition that using a small portion of land for construction of hostel will affect the academic activities of Ramanujan Institute for Advances Study in Mathematics (RIASM), to say the least, is completely baseless. There is nothing in the petition which shows that the academic activities of RIASM would be adversely affected.

3. It is unfortunate that some elements, in order to forestall public work, have misled the petitioner, a student, to file the PIL before this Court on such frivolous issues.

4. Petition is dismissed. Though we are inclined to impose heavy exemplary costs, considering that the petitioner is a student, we are inclined to impose a nominal cost of Rs.10,000/- (Rupees ten thousand only) payable to the Tamil Nadu State Legal Services Authority, within a period of one month from today. The interim application stands

closed.

The petitioner is to not indulge in filing such frivolous petition and concentrate more on his studies.
