O R D E R
A joint endorsement has been made by both the counsels on instructions that they are agreeable for the appointment of an Arbitrator by this Court pertaining to the subject matter of the dispute between the parties namely Franchise agreement dated 27.01.2023. The respective parties have also reserved their rights to protect their respective interest by filing an application under Section 17 of the Arbitration and Conciliation Act before the Arbitrator appointed by this Court.
2. After recording the endorsement made by both the counsels, this Court
appoints The Hon'ble Mr.Justice K.N.Basha, Former Judge, Madras High Court, residing at No.25/1, "STAR", F1, Dr.Ambedkar Road (Old ICF Link Road), North Thirumalai Nagar, Villivakkam, Chennai - 600 049 (Mobile No.9444454545) as an Arbitrator to adjudicate the dispute between the parties arising out of the franchise agreement dated 27.01.2023 entered into between the applicant and the respondent. Both the counsels have also agreed, on instructions, that this application can be disposed of by granting liberty to both the parties to approach the Arbitrator appointed by this Court to seek for interim protection, if they so desire, pending arbitration under Section 17 of the Arbitration and Conciliation Act, 1996.
3. The Arbitrator shall be paid his remuneration/fees in accordance with the 4th Schedule of the Arbitration and Conciliation Act, 1996. Both the parties shall equally share the Arbitrator's fees.The Arbitrator shall conduct the arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996 and shall complete the arbitration within the specified time as prescribed under the said Act.
4. Since this Court has appointed an Arbitrator based on the joint endorsement made by both the counsels, on instructions, this Application is disposed of, without extending the interim order granted earlier by this Court in this application. However, the parties are granted liberty to approach the arbitral
Tribunal seeking for interim protection including the relief which has been prayed for in this application before the Arbitrator under Section 17 of the Arbitration and Conciliation Act, 1996 and the Arbitrator shall consider the same on merits and in accordance with law.
