This writ petition has been filed in the nature of a Certiorarified Mandamus, seeking records relating to the Proceedings dated 10.12.2024 of the first respondent and quash the same and permit the petitioner to continue as Assistant Superintendent at Government Vigilance Home for Women, Mylapore, Chennai - 4 pursuant to the order dated 30.12.2023 issued by the Director of Social Defence. 2.The learned counsel for the petitioner pointed out that the petitioner is working as an Assistant Superintendent in the Directorate of Child Welfare and Special Services and has been posted at various Government Vigilance Homes across the State. The petitioner, who was initially working at the Government Vigilance Home in Mylapore, Chennai, was transferred to Cuddalore. However, she was permitted to Page No.2 of6
continue her service in Chennai. Subsequently, she was re-transferred to Chennai. In the meantime, by order dated 03.01.2024, the Director of Social Defence promoted another individual Ms.R.Sudhapriya, Assistant Superintendent, to the post of Superintendent and posted her at the Government Vigilance Home for Women, Salem, and also on deputation as Superintendent in-charge at the Government Children Home, Royapuram, Chennai.
3.The petitioner was subsequently posted to the Government Vigilance Home at Mylapore. She was also allotted official quarters, where she took residence. However, the impugned order dated 10.12.2024 came to be passed, transferring her from the Government Vigilance Home at Mylapore to the Government Home for Children, Royapuram. This appears to have caused a concern to the petitioner, who likely apprehended that she would be directed to vacate the quarters at Mylapore. However, that cannot be the intention of the respondents. The first respondent passed the order transferring Ms.R.Sudhapriya, pursuant to her promotion as Superintendent, and placed her in charge as Superintendent at the Government Vigilance Home, Mylapore. 4.The petitioner has now been transferred to the Government Page No.3 of6
Vigilance Home at Royapuram, Chennai. She is permitted to retain the official quarters, which was allotted to her in her capacity as Assistant Superintendent, a post she continues to hold. The petitioner may continue to occupy the said quarters so long as she is posted in Chennai, and thereafter, she shall abide by the applicable rules, regulations, and guidelines relating to the allotment of government quarters. This arrangement is expected to address the petitioner's concerns while she remains in Chennai and no further orders are deemed necessary at this stage.
5.The writ petition stands disposed of with the above observation. No costs. Consequently, connected miscellaneous petitions are closed.
