ORDER

This writ petition is filed seeking a writ of mandamus, directing the 1st respondent to pass appropriate orders to regularise the petitioner's service as a Clerk / Jewel Appraiser in the 4th respondent society viz, SS .62 Salem District Adi Dravidar, Schedule Tribe and Backward Class Welfare Department Government Employees Cooperative Thrift and Credit Society Ltd, by considering the petitioner's representation dated 03.09.2025.

The learned counsel for the petitioner would submit that the petitioner was appointed as a Clerk / Jewel appraiser in the 4th respondent society on 18.04.2025; the petitioner had worked for 20 years; since the petitioner's service was not regularised, the petitioner filed ID.No.112 of 2019, before the Labour Court, Salem; the Labour Court, Salem, passed an award on 17.04.2021, directing the 4th respondent to regularise the petitioner's service with effect from 01.04.2007.

The learned counsel would further submit that the 4th respondent filed WP.No.25742 of 2021, challenging the award passed in ID.No.112 of 2019, by the Labour Court, Salem and obtained an order of stay and the said writ petition is still pending; since the petitioner's service was not regularised, the petitioner sent a representation dated 03.09.2025, to the respondents requesting them to regularise her service, fix her pay scale and other allowances; aggrieved by the inaction on the part of the respondents, the petitioner has approached this Court seeking a direction to the respondents to regularise her service.

4. Per contra, Ms. E.Ranganayaki, learned Additional Government Pleader appearing for respondents 1 to 3 would submit that the award passed in ID.No.112 of 2019 has been stayed. Therefore, no order can be passed by the respondents on the representation made by the petitioner.

5. Mr. G. Nanmaran, learned Special Government Pleader, appearing for the 4th respondent also submits that orders can be passed only after the final order passed in the said writ petition.

6. Heard the learned counsel on either side and perused the records.

7. Considering the fact that the award dated 17.04.2021, passed in ID.No.112 of 2019 in favour of the petitioner has been stayed in WP.No.25742 of 2021 and the said writ petition is still pending, the petitioner's representation can be considered only after the ultimate result of the said writ petition and at this stage, this Court cannot issue a direction to the respondents to consider the petitioner's case.

8. This writ petition is disposed of with the above observation. No costs.
