ORDER

The petitioner, who was arrested and remanded to judicial custody on 12.08.2025, for the offences punishable under Section 126(2), 296(b), 118(1), 109 and 309(4) of BNS in Crime No.259 of 2025, registered on the file of the respondent police, seeks bail.

The case of the prosecution is that on 11.08.2025, the petitioner along with other accused waylaid the defacto complainant and snatched a sum of Rs.1,050/- at knife point. Hence, this case. 3.

The learned counsel appearing for the petitioner submitted that on account of previous enmity over land dispute, a false complaint was lodged against the petitioner and there is no injury to anyone during the alleged occurrence and no one is hospitalized. He further submitted that already the matter and civil dispute was compromised between the parties and the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner. 4.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and states that the petitioner has 12 previous case pending against him. He further submitted that this Court has dismissed the earlier bail application filed by the petitioner in Crl.O.P.No.25698 of 2025 dated 18.09.2025.

Considering the facts, nature of offence and the fact that this Court has dismissed the earlier bail application filed by the petitioner in Crl.O.P.No.25698 of 2025 dated 18.09.2025 and there is no change in circumstances, this Court is not inclined to grant bail to the petitioner. 6.
