ORDER
This Suo Motu case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.)No.618 of 2025. 2.This case is registered in Cr.No.405 of 1991 for the alleged offences under Section 302 of IPC, 1860. This is an occurrence of the year 1991. The accused is said to have stabbed the deceased on the left side of his chest and caused death due to previous enmity. The case is pending from the year 1991. 3. It stated that in spite of best efforts of the police, the warrant could not be executed. Under such circumstances, it is a fit case on exercise of power under Article 226 of the Constitution of India. Thus, the case is closed by giving liberty to the prosecution to continue the case, if the accuse resurfaces or any fresh clue against the accused is obtained. 4.With the said liberty reserved to the prosecution, in P.R.C.No.100015 of 2008 of Judicial Magistrate Court, Pappireddipatti Taluk, Dharmapuri, PRC is treated to be closed. This Suo Motu Transfer Case is disposed of. 14.10.2025 sha electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
