ORDER

This Suo Motu case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.)No.618 of 2025. 2.This case is registered in Cr.No.421 of 1993 for the alleged offences under Section 395 of IPC r/w. Section 397 & 34 of IPC. The allegation in this case is that the accused committed theft of certain properties of the complainant. 3. It is stated that A1 is believed to have been died but however since the same could not be confirmed for want of death certificate, the matter is kept pending. However A2 and A3 have confirmed to be died. No useful purpose will be served in keeping the matter pending. No meaningful trial is possible even if A1 is alive.

4. Accordingly, the case in P.R.C.No.100004 of 2008 of Judicial Magistrate Court, Pappireddipatti Taluk, Dharmapuri, stands quashed. This Suo Motu Transfer Case is disposed of.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
