O RDER This Writ Petition has been filed for direction directing the respondent to allow the petitioner to join in his duty as Junior Engineer in Thirupur City Municipal Corporation.

2. Heard both sides and perused the materials available on record.

3. While serving as a Junior Engineer, the petitioner was trapped in a corruption case by the Inspector of Police, Vigilance and Anti Corruption, while receiving bribe. Immediately, he was arrested and remanded to judicial custody and he was deemed to be suspended from service by order, dated 27.08.2024. Now, the criminal case is also pending for investigation. Instead of challenging the order of suspension, the petitioner has filed this writ petition seeking permission to join duty as Junior Engineer, which is per se unsustainable. Further, it is pertinent to note that the petitioner had committed a very serious offence against the society and as such, he was rightly suspended from service. Page No.2 of 6

Pending the present writ petition, the petitioner has also filed a writ miscellaneous petition in W.M.P.No.38968 of 2025 before this Court, seeking direction to the respondent to grant 75% of subsistence allowance to him. However, already the petitioner is receiving subsistence allowance in accordance with law. In view of the above, the direction sought for in this writ petition seeking permission to join duty in the post of Junior Assistant cannot be granted, since the order of suspension passed against the petitioner is still in force. Hence, the writ petition is devoid of merits and the same is liable to be dismissed.
