O R D E R

The petitioner, who was arrested and remanded to judicial custody on 27.06.2025 by the respondent police in connection with Crime No.193 of 2025 for the offences punishable under Sections 331(4) & 305(a) of BNS Act, seeks bail.

2.This is the first bail petition. The case of the prosecution is that on 26.06.2025 at about 18.00 hours, the petitioner, along with two others, committed theft from the de-facto complainant's house and stolen one Laptop, one Iron box and two brass candlesticks. Hence, the case. 3.The learned counsel for the petitioner submitted that the petitioner is innocent and and falsely implicated in the case. He further submitted that the petitioner has no connection with the alleged offence and therefore prayed for grant of bail.

4.The learned Government Advocate (Crl.side) submitted that the investigation has been completed and charge sheet has been filed. The case has been taken on file in C.C.No.565 of 2025 by the Judicial Magistrate No.II, Nagapattinam. However, the petitioner has a bad antecedent and is involved in eleven previous cases. Hence, if the

petitioner is released on bail, he is likely to commit similar offences.

5. Considering the fact that the petitioner is a habitual offender with eleven previous cases, and though the final report has already been filed and the same is pending before the trial Court, this Court is not inclined to grant bail to the petitioner, as there is no change in the circumstances of the case.

6. Accordingly, this Criminal Original Petition is dismissed. 13-10-2025 nvi To
