ORDER

The revision has been filed challenging the judgment rendered in Criminal Appeal No. 167 of 2024 by the file of the I Additional District and Sessions Judge, Coimbatore confirming the judgment of conviction and sentence passed by the Judicial Magistrate, Fast Track Court at Magisterial Level-II, Coimbatore __________Page 1 of 4

in C.C.No.352 of 2020 for the offence punishable under Section 138 of the Negotiable Instruments Act and sentencing him to undergo simple imprisonment for six months and to pay a sum of Rs.4,50,000/- towards compensation and in default to undergo simple imprisonment for a further period of one month.

2. This court, by order dated 10.10.2025, had suspended the sentence of imprisonment of the petitioner on a condition that the petitioner should deposit a sum of Rs.1,60,000/- to the credit of C.C.No.352 of 2020. However, it appears that even before the order passed by this court, the petitioner was arrested on 9.10.2025 in execution of the judgment passed by the appellate court.

3. Whileso, learned counsel for the petitioner has produced a copy of the letter written by the petitioner from the Central Prison, Coimbatore, which is duly attested by the Additional Superintendent of Central Prison, Coimbatore, stating that the petitioner does not intend to pursue the revision and is willing to serve the remaining period of sentence in prison.

4. In view of the stand taken by the petitioner, the learned counsel for the petitioner is permitted to withdraw the revision. Accordingly, the criminal revision petition is dismissed. Consequently, the petitioner shall serve the sentence imposed on him by the Trial Court, as confirmed by the appellate court.
