ORDER

The petitioner, who was arrested and remanded to judicial custody on 15.06.2025 for the offences punishable under sections 191(2), 191(3), 296(b), 115(2), 118(1), 140(1), 109, 351(3) of BNS in Crime No.324 of 2025 on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the petitioner along with other accused attacked the victim with a knife and sickle and also threatened the victim with dire consequences.

3.The learned counsel appearing for the petitioner submitted that the injured was discharged from the hospital and the petitioner is in prison for more than 67 days. He further submitted that earlier application was dismissed on the ground that some of the accused are absconding; now they have been secured. 4.The learned Government Advocate (Crl.Side) appearing for the respondent police reported that this is the second bail application and the earlier bail application was dismissed by this Court in Crl.O.P.No.21292 of 2025 dated 21.08.2025.

5. This Court earlier dismissed the bail application filed by the petitioner on the following reasons;

"4. The learned Government Advocate (Crl.Side) objected that the petitioner is a habitual offender and he is having 6 previous cases and this incident has happened as a retaliatory murder of the earlier murder. Two of the accused are still absconding and there is danger to the life of the defacto complainant who is surviving the brutal attack.

5. Considering the said fact, this Criminal Original Petition stands dismissed."

6.This is an successive bail application and the petitioner has bad antecedents and has not made out any case of change in circumstances. Hence I am not inclined to revisit the earlier order passed by this Court. According, this Criminal Original Petition is dismissed.
