ORDER
This writ petition has been filed directing the respondents 1 to 5 to furnish the account details and deposited amount particulars of the petitioner's father namely Santhavaliyan S/o.Muthu and consequently forbearing the Page No.2/5
respondents 1 to 5 from permitting the respondents 6 and 7 to withdraw the deposited amounts from the respondents bank 1 to 5, deposited by the petitioner's father without the consent and knowledge of the petitioner, by considering petitioner's representation dated 14.12.2024.
2. Heard, Mr.Paranjothi, the learned counsel appearing on behalf of the petitioner.
3. The grievance expressed by the learned counsel for the petitioner is that the petitioner has a dispute with his mother and sister. The mother is trying to withdraw the amount deposited by the father in the bank account, even though the petitioner is also entitled to a share.
4. For the said grievance, the petitioner has to approach only the Civil Court, as there is no statutory right or public duty involved in the matter so as to entertain the writ petition under Article 226 of the Constitution of India. The dispute is purely a partition issue and if any urgent order is required, the petitioner can very well pray in the Civil Court. Except for keeping open the Page No.3/5
rights of the petitioner to approach the appropriate Civil Court, the writ petition stands dismissed.
