Prayer :- Writ Petition filed under Article 226 of the Constitution of India 1/5

praying for the issuance of a Writ of Certiorari to call for records of the fourth respondent in Na.Ka.No.11/2023/A1/Tha.Ma.Va.A/Thiruvallur dated 07.06.2023 and to quash the same as illegal.

Government Pleader For Respondent-3 : Mr.Abishek Murthy Standing Counsel O R D ER When the Writ Petition is taken up for hearing today, the learned Additional Government Pleader for respondent/Government submitted that the challenge in this Writ Petition is to the notification issued by the fourth respondent-SIPCOT under Section 3(2) of the Tamil Nadu Acquisition of Land for Industrial Purposes Act, 1997 (Act 10 of 1999) dated 07.06.2023. The learned Additional Government Pleader would submit that the petitioners, on receipt of 3 (1) notification filed their objections, and the said objections were overruled by the respondent-Authorities; that thereafter, the respondents, in terms of section 2(c) of the said Act are supposed to declare the acquired land as land meant for industrial purposes, and accordingly, the respondents, as a pre-condition of the said Act, issued notice under Section 3

(2) dated 07.06.2023 and therefore, it is fairly submitted that if at all the 2/5

petitioner is aggrieved, the petitioner has to challenge the order dated 12.08.2022 issued by the first respondent, inasmuch as, the notice which is impugned herein is nothing but a show cause notice, flowing out of the order passed by the first respondent dated 12.08.2022.

This Court also finds force in the submissions made by the learned Additional Government Pleader for respondents that once 3 (1) notification was issued, objection was filed and the same was overruled, and thereafter, 3 (2) notification was issued, certainly, the petitioners have to challenge the subsequent notification issued, but, insofar as the present case is concerned, since, the said 3 (2) notification dated 07.06.2023 (impugned herein) is an outcome of the order passed by the first respondent dated 12.08.2022, the petitioner has to first challenge the said order dated 12.08.2022.

3. In view of the above, this Writ Petition is dismissed as infructuous. No costs. Consequently, connected Miscellaneous Petition No.131 of 2025 is ordered and W.M.P.No.132 of 2025 is closed. 22.10.2025 3/5
