ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025. 2.The case in C.C.No.195 of 2015 was taken on the file of the Judicial Magistrate Court, Rasipuram Taluk, Namakkal for the alleged offence under Section 381 I.P.C. The occurrence is said to have taken place on 02.06.2012. In this case, the lorry has been recovered and handed over to the de-facto complainant, however it is seen that a sum of Rs.93,000/- was not recovered. Therefore, the de-facto complainant is not consenting for quashing the case. Be that as it may, this occurrence is of the year 2012, it is stated that despite the best efforts of the police, the accused could not be traced out. Page No.1 of 2 https://www.mhc.tn.gov.in/judis

3. Under these circumstances, this is a fit case, which requires exercise of extraordinary jurisdiction under Article 226 of Constitution of India to close the case. However, with liberty to the prosecution to reopen and conduct the case if there is any clue against the accused and if the accused resurfaces in future.

4.Accordingly, the case in C.C.No.195 of 2015of Judicial Magistrate Court, Rasipuram Taluk, Namakkal stands disposed of. This Suo Motu Transfer Case is disposed of.

07.10.2025 mp electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
