ORDER

This Criminal Original Petition has been filed to not to harass the petitioner and direct the first respondent to take appropriate action against the second and third respondents for illegal action in involving the Civil dispute by considering the petitioner's representation dated 28.09.2025.

2. The case of the petitioner is that on the complaint given by one Ram Gopal, the second and third respondents are threatening the petitioner to vacate the house and shop and hand over possession. In this regard, the petitioner had given representation to the first respondent. However, the same has not been considered by the first respondent. Hence, the present petition has been filed.

3. The learned Government Advocate [Criminal Side] on instructions submitted that a current paper enquiry is pending against the petitioner.

4. Such being the position, it is for the investigating agency to issue appropriate notice to the petitioner under Section 35(3) of BNSS for enquiry and on such notice, the petitioner shall appear for enquiry and co-operate with the investigation. If any cognizable offence is made out, the third respondent shall proceed as per law.

5. With the above direction, this Criminal Original Petition is disposed of.
