Mr.A.Gopinath Government Advocate (Crl.Side) COMMON ORDER The petitioners, who were arrested and remanded to judicial custody on 04.09.2025, for the alleged offence punishable under Sections 4(1)(aaa) r/w. 4(1-A) of the TNP Transport Act, 2024, in Crime No.394 of 2025, on the file of the respondent police, seeks bail.

2.The allegation against the petitioners, these petitioners along with three other petitioners have involved in transporting of 48 Black pearl beer bottles(each in 750 ml), 24 Directors club brandy bottles (each in 750 ml), 100 Directors club brandy bottles(each in 90 ml), 48 King Louis brandy bottles (each in 180 ml) and 110 liters of illicit arrack in the car and two wheeler.

3. The learned counsel for the petitioners submitted that the petitioners are in custody from 04.09.2025. Hence, prayed for grant of bail to the petitioners.

4. Per contra, the learned Government Advocate (Crl.side) appearing for the respondent police reported that this is the second bail application and the earlier bail application was dismissed by this Court in Crl.O.P.Nos.26040 & 26044 of 2025 dated 22.09.2025. Hence opposed to grant bail to the petitioners. 5.This Court earlier dismissed the bail applications filed by the petitioners in Crl.O.P.Nos.26040 & 26044 of 2025 dated 22.09.2025 on the following grounds:

"5.Considering the fact that the petitioners are having 3 previous cases against each of them and also they are transporting huge quantity in the car and two-wheeler, this Court is not inclined to grant bail to the petitioners. 6.In view of the above, this petition has been filed within a week without any change in circumstances. Hence, I am not inclined to grant bail to the petitioners. Accordingly, this Criminal Original Petition is dismissed. 17-10-2025 Mpa Index:Yes/No Speaking/Non-speaking order
