ORDER
This Suo Motu case is dealt with in an extraordinary manner by this Dedicated Bench, pursuant to Suo Motu W.P.(Crl.)No.618 of 2025.
2. The case is registered for alleged offence under Section 200 of Criminal Procedure Code for offence under Section 15 read with 16 & 19(a) of the Environment (Protection) Act, 1986. The allegation in this case is that the first accused company and the second accused being the whole time Director has put up a construction of about 20,000/- sq.ft., without getting environmental clearance. Though the magnitude of their building, it is mandatorily required that they should obtain prior environmental clearance, the same is punishable offence as per Section 15 of Environment (Protection) Act r/w 16(1) of the Environment Protection Act, 1986. It can be seen that the accused are facing the case for the past 10 years. Page No.1 of 3

In view of the above and considering the fact that both the accused are pleading guilty through the learned counsel present before this Court, I am of view that fine amount of Rs.50,000/- can be levied by only considering the fact that the accused have already faced the case for a period of ten years. Accordingly, a fine amount of Rs.50,000/- (Rupees Fifty Thousand Only) shall be paid in the next date of hearing before the learned Magistrate, in default, each of the accused shall undergo simple imprisonment of three months. The fine amount shall be paid by the accused on the next date of hearing before the Trial Court.
4. Accordingly, the case in CC.No.349 of 2015 on the file of Chief Judicial Magistrate Court, Chengalpattu, stands quashed and this Suo Motu Transfer case is disposed of.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
