Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the third respondent to consider the representation dated 26.07.2024 submitted by the petitioner to the first respondent, conduct an enquiry to cancel the patta issued in respect of the lands owned by the petitioner.

ORDER

This Writ Petition has been filed for the issue of writ of mandamus directing the 3rd respondent to deal with the representation made by the petitioner on 26.07.2024 wherein the petitioner is seeking for cancellation of patta issued in favour of the private respondents with respect to the subject property.

2.Heard Ms.G.Kannagi, the learned counsel appearing on behalf of the petitioner and Mr.P.Sathish, the learned Additional Government Pleader appearing for the respondents 1 to 4.

3.The case of the petitioner is that the subject property was originally 2/5

owned by the petitioner's grand father. On his demise, the property was succeeded by the petitioner's father and his grand mother. In the year 2012, the petitioner's father and grand mother executed settlement deed in favour of the petitioner on 22.05.2012 which was registered as document No.1213 of 2012. Based on this document, the petitioner submitted an application for issuance of patta and at that point of time, he came to know that the names of the private respondents have already been entered in the revenue records. Initially complaints were given in this regard by the father of the petitioner and this complaint not acted upon. Thereafter, the petitioner gave a complaint on 26.07.2024 and it is pending before the 3rd respondent without any progress. It is under these circumstances, the present writ petition has been filed before this Court.

4.Taking into consideration the facts and circumstances of the case and the materials placed before this Court and considering the limited relief sought for in this writ petition, there shall be a direction to the 3rd respondent to deal with the representation made by the petitioner on 26.07.2024 on its own merits and in accordance with law after affording opportunity to the private respondents and 3/5

final orders shall be passed within a period of eight (8) weeks from the date of receipt of a copy of this order.

5.This writ petition is disposed of with the above directions. No costs. 05.02.2025 Index : Yes / No kas To.
