ORDER

The petitioner apprehends arrest for the alleged offence under Sections 303(2) and 326 of of BNS in Crime No.245 of 2025, on the file of the respondent police seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with other accused illegally quarried 1/2 unit of sand from the Chengundran river and while they were transporting the same, the officials have intercepted, after seeing officials they ran away from the scene of occurrence. Hence the case.

3. The learned counsel for the petitioner submitted that the petitioner is not having any previous case and prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.side) appearing for the respondent police reported that 1⁄2 unit of river sand was taken away and it was illegally quarried from the river. Hence, he opposed to grant anticipatory bail to

the petitioner.

5 Considering the nature of offence committed by the petitioner, and taking note of the fact that the petitioner is not only involved in illegal quarrying river sand but also in damaging the ecology and the river itself, this Court is not inclined to grant anticipatory bail to the petitioner.
