ORDER

In this writ petition, the petitioner has challenged the impugned Order dated 31.01.2023 along with the Order dated 03.02.2023 passed for the Assessment Year 2022-2023.

2. By the first mentioned order, the petitioner was informed that an assessment order under Section 62 in FORM GST ASMT-13 was being issued to the petitioner.

3. The assessment order in FORM GST ASMT-13 indicates that the petitioner was in arrears of tax for the month of November 2022.

4. The learned counsel for the petitioner has attempted to establish that the petitioner paid the entire tax along with interest and late fees, when filing the monthly return in GSTR-3B on 02.03.2023.

5. A reading of the said return prima facie reveals that apart from the 2/4

tax liability, the petitioner has discharged the interest and late fees, as specified in Table 5.1 of the aforesaid return, which is reproduced below: Details Integrated tax Central tax State/UT tax Cess System Computed Interest 3824.39 107.77 107.77 - Interest Paid 3824.39 107.77 107.77 0.00 Late fee - 1475.00 1475.00 -

6. Considering the same, there shall be a direction to the respondent to re-look into the issue and pass appropriate orders in accordance with law, within a period of 30 days from the date of receipt of a copy of this order.
