Petition seeking bail in respect of Crime No.19 of 2024 registered for the offences punishable under Sections 9(n), 9(l) and 10 of Protection of Children from Sexual Offences Act, 2012, is on board for consideration. 1/4
2. The incarceration of the petitioner/A1 being from 06.10.2024 pleading innocence on the part of the petitioner and false implication in the case, learned counsel for the petitioner seeks indulgence of this Court. He also submits that the petitioner is in no way connected with the alleged offences, however, due to family dispute, a false complaint has been given against the petitioner and he is in custody for more than two months. He further submits that the petitioner is ready to abide by any stringent condition that may be imposed by this court.

The case of the prosecution, as putforth by the learned Government Advocate (Criminal Side) appearing for the respondent police, opposing for grant of bail, is that the petitioner, who is the Stepfather of the minor victim girl, aged about 14 years, had misbehaved with her and inappropriately touched her private parts. He further submits that the statement under Section 183 of BNSS has also been recorded from the victim and the video taken by the victim girl showing the sexual assault made by the petitioner is also available. He also submits that the charge sheet has also been filed in this case and it is yet to be numbered, therefore, if the petitioner is released on bail, there is every possibility of him absconding and threatening the witnesses.

Having heard the learned counsel for the petitioner, the learned Government Advocate (Criminal Side) for the respondent Police and perused the materials available on record including the statement recorded from the minor victim girl under Section 183 of BNSS and considering the conduct of the petitioner and also taking note of the fact that the charge sheet has also been filed, this court is not inclined to grant bail to the petitioner.
