: Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue Writ of Declaration, declaring that the denial of employment to the petitioner as part time Sweeper in Serambadi Branch Library in Nilgiris District from 21.07.2022 by the respondents as arbitrary and illegal and consequently direct the respondents to reinstate the petitioner in service with back wages and all other attendant benefits as provided in G.O.385, Finance Department dated 01.10.2010 and the subsequent revisions as issued by the Tamil Nadu Government. 1/4

ORDER

This writ petition has been filed for a declaration declaring that the denial of the employment to the petitioner as part-time Sweeper in Serambadi Branch Libarary in Nilgiris District from 21.07.2022 by the respondents as arbitrary and illegal.

2. The petitioner was employed in the fourth respondent Library as part-time Sweeper from 01.01.2006. Thereafter, she was disengaged by the fourth respondent as early as on 21.07.2022. Now, after a period of three years, the petitioner seeking declaration that her denial of employment as illegal. In the meanwhile, the petitioner also raised industrial dispute, and it was rejected on the ground that it was not maintainable. Therefore, the petitioner has no right to claim any relief seeking declaration. That apart, the G.O.Ms.No.385, Finance Department dated 01.10.2010 issued for the regularization of service of the part-time Sweepers by granting Special Time Scale of Pay to the part-time Sweepers cannot be invoked to 2/4

the petitioner's case since even at the time of her part-time employment, she was not consider for special time scale of pay.

3. In view of the above, the writ petition is devoid of merits and therefore, the writ petition stands dismissed. No costs. Consequently, connected miscellaneous petition is closed.
