Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a Writ of Mandamus, directing the 2nd and 3rd Respondents to measure the petitioner's properties in Survey No.37/3 to 1/4

an extent of about 16 1/2 cents and in Survey No.37/5B2 to an extent of about 2 acre 35 1/2 cents land in Koneripatti Village, Gagavalli Taluk, Salem District, by disposing of the petitioner's online application dated 11.12.2024 vide petition No.2024/0123/08/006706 with the aid of the 4th Respondent.

O R D E R

This writ petition has been filed seeking for issue of a writ of mandamus directing the second and third respondents to act upon the application submitted by the petitioner on 11.12.2024, wherein the petitioner has sought to measure the subject property and to fix boundary stones.

2. Heard the learned counsel for the petitioner, the learned Government Advocate for the respondents 1 to 3 and the learned Government Advocate for the fourth respondent.

3. The case of the petitioner is that he is the absolute owner of 2/4

the subject property by virtue of a registered sale deed dated 09.09.2009 registered as Document No.1458 of 2009. The petitioner was issued with joint patta in patta Nos.534 and 1221. The petitioner wanted to survey the subject property and hence, he submitted an online application on 11.12.2024, after paying necessary charges. Since the same was not considered, the present writ petition came to be filed before this Court.

Taking into consideration the facts and circumstances of the case and considering the materials placed before this Court, there shall be a direction to the second and third respondents to act upon the online application submitted by the petitioner on 11.12.2024 and to conduct survey in the subject property based on the title document and joint pattas that stand in the name of the petitioner. Since there are joint pattadars, the said survey shall be conducted in their presence. This process shall be completed within a period of four weeks from the date of receipt of a copy of this order. If the revenue authorities feel that police protection is required, they can seek police protection from the fifth respondent and the same shall be provided by the fifth respondent.
