Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of Mandamus, directing the 2nd and 3rd Respondents to measure the petitioner's properties in Survey No.37/2 to an extent of about 1 1/4 cents, in Survey No.37/3 to an extent of about 8 1/4 cents and in Survey No.37/5B2 to an extent of about 1 acre 17 1/2 cents land in Koneripatti Village, Gangavalli Taluk, Salem District, by disposing 1/5

O R D E R

This Writ Petition has been filed for a direction directing the 2nd and 3rd Respondents to measure the petitioner's properties in Survey No.37/2 to an extent of about 1 1/4 cents, in Survey No.37/3 to an extent of about 8 1/4 cents and in Survey No.37/5B2 to an extent of about 1 acre 17 1/2 cents land in Koneripatti Village, Gangavalli Taluk, Salem District, by disposing of the petitioner's online application dated 19.09.2025 vide petition No.2025/0123/08/013125 with the aid of the 4th Respondent and the same within a time to be stipulated by this Hon'ble Court.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

The case of the petitioner is that she is the owner of the land comprised in Survey No.37/2 measuring to an extent of about 1 1/4 cents, in Survey No.37/3 measuring to an extent of about 8 1/4 cents and in Survey No.37/5B2 measuring to an extent of about 1 acre 17 1/2 cents lands in Koneripatti Village, Gangavalli Taluk, Salem District.. In order to survey the said lands, she submitted an application before the respondents 1 to 3. However, the respondents 1 to 3 did not take any steps to survey the aforesaid lands so far.

In view of the above, the 2nd respondent is directed to survey the petitioner's aforesaid land based on the title deed produced by the petitioner, after issuance of notice to the adjacent land owners and counter parties, if any, and to serve the survey report to the petitioner within a period of six weeks from the date of receipt of a copy of this order. It is made clear that, if the surveyor concerned is obstructed by third parties while surveying the subject land, the said surveyor can approach the jurisdictional police seeking police aid and on such request, the jurisdictional police shall provide adequate police protection to the surveyor.

5. With the above directions, this writ petition is disposed of. There 3/5

shall be no order as to costs.
