Aggrieved by the judgment of acquittal of the respondent, the petitioner/complainant has filed the present petition seeking leave to file an appeal.

2.The learned counsel for the petitioner would submit that though the respondent had not disputed the signature in the cheque, the Trial Court had erroneously concluded that the respondent had made payments towards the cheque amount; and that the petitioner had established that the payments were not towards the cheque amount and therefore the leave may be granted to file an appeal.
