ORDER
This writ petition has been filed by the petitioner seeking to forbear the nd respondent from entertaining the document submitted by the respondents 3 & 4 with regard to old survey No 179/2, to an extent Acre 1.92 Cents, UDR survey No 57/2, to an extent hectare 0.77.50 Are in patta No 1 and 2 situated at Vengalam West Village, Vepanthattai Sub-Registrar Office, Peramablur District and to direct the 2 nd respondent to consider the protest petition dated 16.09.2025 filed by the petitioner.
2.Mr.P.Harish, learned Government Advocate, takes notice on behalf of the respondents 1 & 2. By consent of the parties, the main writ petition is taken up for disposal at the admission stage itself. 3.Learned counsel for the petitioner would submit that the subject property was purchased by the petitioner's father on 29.08.1981 and the petitioner's father died intestate on 22.07.1982, leaving behind his six children. The petitioner, and his two sisters viz., Jagathambal and Amudha were born to
the petitioner's father Late Muthu and his first wife Saroja. The other three legal heirs viz., Mani, Ravi and Baby were born to Late Muthu and his second wife Pooncholai. The petitioner has filed a partition suit in O.S.No.929 of 2019 on the file of the District Munsif Court, Veppanthattai seeking for separate possession of his lawful share in the subject property. During the pendency of the suit, suppressing the pending proceedings, the second wife of the petitioner's father and her sons Ravi and Mani executed a sale deed in favour of Ravi's rd respondent herein. Therefore, the petitioner filed a protest petition wife/the 3 nd respondent objecting to register any of the on 17.03.2025, before the 2 document in respect of the subject property.
However, in spite of the protest nd respondent entertained and registered a sale agreement in favour petition, the 2 th respondent executed by the 3 rd respondent. Therefore, the petitioner of the 4 nd respondent not again filed a protest petition dated 16.09.2025, requesting the 2 to register any further dealings in the subject property. Though the said protest nd respondent, there is no response from the 2 nd petition was duly served on the 2 respondent till date. Hence, the present writ petition has been filed.
4.Learned Government Advocate appearing for the respondents 1 & 2 would submit that if the protest petition has filed in a proper format on a 100 nd respondent will consider the same and conduct rupees stamp paper, the 2 enquiry by issuing notice to the petitioner as well as the other parties concerned in the event any document is presented for registration in respect of the subject property by the respondents 3 & 4.
5.Heard the learned counsel for the petitioner and the learned Government Advocate appearing for the respondents 1 & 2. 6.Considering the submissions made by either parties, this Court directs nd respondent to conduct enquiry in the event the respondents 3 & 4 the 2 presented any document for registration with regard to the subject property after issuing notice to the petitioner as well as the other parties concerned and thereafter, take a decision regarding the registration, in accordance with law.
