ORDER

The present Petition has been filed to set aside the order made in C.M.P.No.1790 of 2025, dated 26.06.2025 on the file of the learned Principal 1/4

Sessions Judge, Salem and consequently to relax the condition imposed in Crl.M.P.No.1618 of 2025 dated 06.06.2025 on the file of the learned Principal Sessions Judge, Salem.

2. The petitioner was originally charged for the offences punishable under Sections 296(b), 118(1) and 351(3) of BNS. While granting bail, the trial court directed the petitioner to appear and sign before the learned Judicial Magistrate, Omalur daily at 10.00 a.m., except holidays until further orders (for a minimum period of 30 days)

4. It is the contention of the petitioner that the petitioner was complying with the conditions from 10.06.2025 to 17.06.2025. As the petitioner is a Engineering Student, in view of his classes, he cannot appear for 30 days, therefore, he sought for modification of the said condition, however, the same has been dismissed, hence the present petition.

5. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent and perused the documents placed on record.

6. Considering the nature of the charges slapped against the petitioner and the petitioner being a student and no adverse remarks brought against him by 2/4

the prosecution, this Court is inclined to set aside the order passed by the learned Principal Sessions Judge, Salem in Crl.M.P.No.1790 of 2025 dated 26.06.2025 and the condition imposed by the learned Principal Sessions Judge, Salem in Crl.M.P.No.1618 of 2025 dated 06.06.2025, viz., to appear and sign before the Judicial Magistrate, Omalur daily at 10.00 a.m., alone is modified to the effect that the petitioner shall appear before the learned Judicial Magistrate, Omalur as and when required. Except the said modification, the order passed by the learned Principal Sessions Judge, Salem in Crl.M.P.No.1618 of 2025 dated 06.06.2025, shall remain intact.
