ORDER

This Criminal Original Petition has been filed to quash the First Information Report registered in Crime No.138 of 2025 on the file of the respondent for the offences under sections 286, 123, 336[2], 336[3] 340[2] of BNS 2023 and sections 24[1] and 6[b] of Cigarettes and other Tobacco Products Act, 2003.

2. The case of the prosecution is that the accused were in possession of banned tobacco products and the same has been seized from the car. The further case of the prosecution is that the tobacco products were brought from Bangalore only in order to sell to nearby educational institution in a car with fabricated number plate. It is the contention of the petitioner is that there is no specific allegation against the petitioner and no offence is made out against him and no contraband has been seized from the petitioner. Hence, seeks to quash the First Information Report.

3. The contentions of the petitioner cannot be gone into at this stage. The First Information Report has been registered on 14.08.2025 and investigation is at the initial stage. Hence, at this stage, the contention of the petitioner that no offence has been made out cannot be gone into without any basis. Hence, I do not find any merits in this petition.
